Man found fit for child rape trial

A Westwood man was declared mentally competent Tuesday and is expected to stand trial on charges of raping a 7-month-old boy.
Shawn Brumfield, 19, is accused of raping his girlfriend's son while baby-sitting the child on two occasions in October.
After a brief hearing in Hamilton County Common Pleas Court, Judge Thomas Crush ruled Mr. Brumfield does not suffer any mental defects that would make him unfit for trial.
The judge said he based his ruling on a six-page report by a court-appointed psychiatrist.
The report concluded Mr. Brumfield has no symptoms of mental illness and appears to understand the charges.
The exam also found Mr. Brumfield abused drugs for many years and was raped as a child by an older man.
Mr. Brumfield's attorney, Greg Cohen, said the report means his client will withdraw his plea of not guilty by reason of insanity. He will, however, continue to plead not guilty.
Police have said Mr. Brumfield was baby-sitting the boy when a first attack occurred Oct. 15.
He is accused of raping the baby again Oct. 16.
The child suffered serious injuries and has been diagnosed with a sexually transmitted disease.
Prosecutor Joseph Deters has said the evidence against Mr. Brumfield includes injuries to the baby that are consistent with rape and a statement Mr. Brumfield gave police after his arrest.
He would not say whether Mr. Brumfield admitted the crime in his statement.
At the time the offense is alleged to have taken place, Mr. Brumfield had lived at his girlfriend's house for about four months.
