Coach may seek dismissal of charges

NEWPORT The case of a Fort Thomas volleyball coach accused of taking more than $13,000 from the bank account of a girls volleyball team remains up in the air, and the coach's attorney said he may seek dismissal of the charges.
Newport attorney Tom Beiting said he will ask that felony charges of theft by deception against Mark Tullis, 43, be dismissed if Mr. Tullis is not indicted in January. He was charged by Fort Thomas police almost three months ago.
Assistant Commonwealth Attorney Jack Porter, who is handling the case for the county, has so far failed to present the Tullis case to a Campbell County grand jury, but said Friday the case is very much alive.
I'm going to meet with another police officer from the Campbell County department who was also involved in the initial investigation, and then we'll know when we will seek an indictment, Mr. Porter said.
The chief investigator in the case was Fort Thomas detective Foy Razor, who is under suspension after being charged by Newport police with misdemeanor fleeing from an officer and tampering with evidence, a felony.
Those charges are the result of a fight involving several people in front of Captain's Cove Lounge two weeks ago. Mr. Razor's son, Bryan, 26, is charged with reckless endangerment for allegedly firing a shot from a pistol during the fight.
Mr. Beiting said the police case against Mr. Tullis was weak and improperly prepared. They accused him of taking much more money than was in the bank account, he said.
