Murder suspect argues one count

HAMILTON The attorney for murder suspect Frank Saunders wants the least serious of three charges against his client to be dismissed.
Greg Howard filed a motion this week asking that Judge H.J. Bressler of Butler County Common Pleas Court dismiss the charge that Mr. Saunders violated a court order to not have weapons.
That order stemmed from a 1986 felonious assault conviction in Adams County.
Mr. Howard's motion said the charge should be dismissed because an Adams County judge expunged that felonious assault conviction in July 1996.
A hearing date for this motion has not been set. Mr. Saunders' trial is to begin on Feb. 8.
He is accused of dragging his ex-girlfriend, Lisa Weber, 39, of Fairfield, into his car on June 9 and shooting her to death.
Mr. Saunders, 39, of Blue Ash, has pleaded not guilty.
