Man, 61, injured in Feb. accident dies




        UNION TOWNSHIP — A Union Township man who was struck along with his wife Feb. 28, as the pair tried to cross Eastgate South Drive, has died.

        Hospital officials at the Drake Center said Earl Ernst, 61, died Sunday shortly before 4 a.m. from respiratory failure.

        However, an autopsy will be conducted by the Hamilton County coroner's office to determine whether the death was the result of the February collision.

        Clermont County Prosecutor Don White said Monday his office will wait for autopsy results before seeking any additional charges against Timothy Davis, 21, of Union Township.

        Mr. Ernst and his wife, Donna, also 61, were walking home from a nearby store when they were struck by a car driven by Mr. Davis.

        Mrs. Ernst was killed, while Mr. Ernst was critically injured.

        He was transferred to the Drake Center on May 16 and was being cared for in the intensive care unit, according to Drake spokesman Guy Karrick.

        Authorities say Mr. Davis was drunk when his car struck the couple.

        He has pleaded not guilty to two counts of driving under the influence of drugs or alcohol, one count of aggravated vehicular assault and one count of aggravated vehicular homicide.

        Mr. Davis will go to trial on those charges in August, Mr. White said.
