Mining firm awaits zoning verdict


Boone Co. court may decide by Sept.

        It won't be until the first of July that a mining company that wants to settle in Boone County reaches its first major hurdle.

        Martin Marietta Materials Inc. won't know until then the recommendation of the zone change committee of the Boone County Planning Com mission.

        “As far as the meeting goes ... there's still some additional information that they may bring back,” said Larry Brown, chairman of the zone change committee. “I would certainly like to have a vote then, but we may not be able to.”

        The full commission isn't scheduled to meet about the issue until August and the Boone County Fiscal Court won't likely make the final decision until September.

        Martin Marietta has submitted three separate applications that would allow underground mining on 575 acres on the north side of Interstate 275 at the Petersburg Road interchange.

        The first application is to rezone the land from agricultural to industrial, allowing for subsurface mining.

        The second is a request for a variance within the industrial zone that would allow a 1,500-foot setback from residential areas instead of 3,000 feet.

        The third proposal is a mixture of industrial and planned development; it would allow the areas not being used to be designated recreational for walking trails and possible parks.

        The company, which is the nation's second largest producer of construction aggregates — crushed stone, sand and gravel used for roads, sidewalks and foundations — has been fighting to develop an underground limestone mine in Boone County for several years.

        The county's zoning codes were eventually changed in 1997, and the mining company filed for a zone change early this year despite resistance from residents.
