Developer sues Mason planners

MASON The owners of a 105-acre parcel east of Ohio 741 and north of Bethany Road are suing city planners, who denied their proposal to build 84 single-family homes.
The lawsuit filed in Warren County Common Pleas Court by Northeast Associates of Loveland claims the Mason Planning Commission used unlawful and improper reasoning to reject the landowners' proposal.
In June, the planning commission turned down Northeast Associates' preliminary plat for a residential subdivision on land zoned single-family residential. Planners based their decision on the fact that Mason's comprehensive plan recommends the property be developed for industrial use despite its existing zoning.
It is unlawful to deny or refuse to approve the platting of real property that is in accordance with existing zoning, said C. Francis Barrett, the developer's attorney.
