Judge dismisses Broadnax drug fine
Former Cincinnati Health Commissioner Stanley Broadnax will not be required to pay the $20,000 fine that was imposed after his drug conviction in 1994.
Judge Melba Marsh threw out the fine Thursday after concluding that Mr. Broadnax was unable to pay because he was broke and jobless.
At a hearing in Hamilton County Common Pleas Court, Judge Marsh noted that the judge at Mr. Broadnax's trial had declared him indigent in 1995.
Judge Marsh said that means prosecutors cannot now ask the court to impose the fines, even if they think his financial situation has improved.
Prosecutors said Mr. Broadnax still owns several parcels of land and may have shielded some assets in a corporation owned by relatives.
Defense attorney William Bell said the city has moved to foreclose on the properties owned by his client. He said Mr. Broadnax is unemployed and relying on family members for financial support.
Mr. Broadnax was convicted of drug abuse and aggravated cocaine trafficking in 1994. He was sentenced to 10 years in prison but was released in 1997 by the parole board.
