The ruling
Writing for the majority, Justice Alice Robie Resnick said the law:
Violated previous Supreme Court decisions that invalidated similar restrictions on lawsuits. Thus, the new legislation was openly subversive of the separation of powers among the ex ecutive, legislative and judicial branches.
Violated the one-subject provision of the Ohio Constitution, which requires that only related matters can be combined in one bill.
Justice Resnick was joined by Justices Andrew Douglas, Francis E. Sweeney Sr. and Paul Pfeiffer.
