Date set for trial in pair's slaying

        HAMILTON — The trial for a man accused of killing a Butler County couple will start Feb. 1.

        Common Pleas Judge Patricia Oney set the trial date Monday for Anthony Larry Rudolph, 42, of Westwood.

        Mr. Rudolph has been indicted on two counts of aggravated murder, two counts of aggravated robbery and one count of having a weapon contrary to a courtorder.

        If convicted, he could receive the death penalty.

        Mr. Rudolph is accused of killing Jimalee Minix, 52, and her longtime companion, Abram W. Smith III, 55. Their bodies were discovered Aug. 5 inside their home in Butler County's Union Township.

        Several hours after the bodies were found, Mr. Rudolph surrendered to authorities in Licking County near Columbus.

        He was released from a state prison a year ago after serving six years of a nine-to-15-year sentence for a Hamilton County robbery.

        Greg Howard is the court-appointed attorney for Mr. Rudolph, who had told the court he could not pay for a lawyer.

        Judge Oney approved a motion Monday asking the court to pay for a psychologist for the defense in the sentencing phase of the trial if Mr. Rudolph is convicted.

        A hearing will be held Dec. 13 on 50 defense motions, many of them concerning trial procedures.
