Four hurt on balcony sue condo owners

        COVINGTON — Owners of a river-view condo where a balcony collapsed during the Riverfest fireworks display are being sued by four people hurt in the accident.

        Paula Jean Wagner, a 19-year-old University of Cincinnati student who was most seriously injured, filed the suit Monday against owners Charles and Judy Thorp of Delray Beach, Fla., and the Riverview Place condo association. Ms. Wagner, of Green Township, has been paralyzed since she fell about 30 feet from the third-floor deck on Sept. 5.

        “Hopefully, she'll be OK,” said Cindy Shirooni, a lawyer representing the injured peo ple. “But it's just too soon to tell.”

        Ms. Wagner and three other Cincinnatians who fell that night allege in their lawsuit that the Thorps and the condo association had a duty to maintain the balcony and keep it safe for guests. Ms. Wagner, Joshua Logan, Matthew Deck and Kristina Hacker all incurred medical expenses, the suit says, and suffered injuries to their wrists, arms and backs.

        Lawyers sought a restraining order Monday to preserve the wreckage as evidence in the suit. Kenton Circuit Judge Patricia Summe granted the order.

        Both the city of Covington and the state housing department are looking into the collapse.
