Boy, 5, hospitalized; legal guardian charged




        A 5-year-old Fairmount boy remained in critical condition at Children's Hospital Medical Center and his aunt was in custody after doctors reported that the boy had been beaten.

        Cincinnati police said Tuesday that they have charged Dorothy M. Young, 44, of 1934 Fairmount Ave., with the felonious assault of Daniel Bronson. She is the boy's legal guardian.

        Friday, the Cincinnati Fire Division was called to Ms. Young's home because the child was hyperventilating. He was taken to Children's and doctors called police.

        Cincinnati homicide investigators are asking that anyone with information regarding the case call 352-3040, or the homicide unit at 352-3542.

Trial date set in cab driver slaying
        A judge Tuesday set April 3 as the start date of the trial for Denise Lipscomb, who was indicted last week on murder charges in the shooting death of a Silverton cab driver.

        Pre-trial motions will be heard Dec. 14 and 15.

        Although three others also were charged with murder in the case, prosecutors say they sought the death penalty for Ms. Lipscomb, of Winton Place, because they allege she is the one who shot John Arcady on Sept. 27 in Winton Terrace.

        If convicted, Ms. Lipscomb could become the only woman on Ohio's death row.

Kroger to take part in Over-the-Rhine project
        The Kroger Co. announced Tuesday that it will become a limited partner in a project to develop market-rate housing in the historic Emery Theatre complex in Over-the-Rhine.

        The project goals are to restore the 88-year-old theater at 1112 Walnut St., and to develop 62 new apartments in the former Ohio College of Applied Science building on Central Parkway.

        Kroger plans to participate in the parts of the project that involve renovating the exteriors of both buildings and developing the apartments.

Plumbing torch caused Oakley fire
       

        A man doing plumbing work early Tuesday accidentally started a fire in his Oakley home, officials said. The blaze caused $20,000 worth of damage but injured no one.

        Cincinnati fire officials said the fire in the two-story home at 3226 Bach Ave. was started by a plumbing torch and was spotted by a neighbor who called 911 around 12:54 a.m.

Man arrested, charged in pedestrian's death
        A 21-year-old Roselawn man was arrested Tuesday and charged with vehicular homicide stemming from the death of a 67-year-old man.

        Police say Matthew White of the 1400 block of Shenandoah Avenue was turning left onto Reading Road from Northwood Avenue when he hit Jacob Raubvogel, also of Roselawn, as he walked in a crosswalk in the 7600 block of Reading Road.

        Mr. Raubvogel died Sept. 8, a day after the accident.

Man charged with harassing I-275 driver
        SPRINGDALE — Police have charged a Hamilton man with ethnic intimidation and aggravated menacing for allegedly harassing a fellow driver along Interstate 275.

        Investigators arrested Steve Devine, 36, of the 700 block of Coralie Avenue, at his job in Blue Ash Tuesday.

        Investigators allege Mr. Devine, who is white, attempted to run a black female driver off the road in June as the two were heading west near Reed Hartmann Highway.

        Mr. Devine was jailed in the Hamilton County Justice Center and could be arraigned today.

Jackknifed truck backs up I-75 traffic
        FRANKLIN TOWNSHIP — A jackknifed semi-trailer truck carrying ice cream shut down the Ohio 73 entrance ramp to Interstate 75 Tuesday night and backed up traffic for several hours on northbound I-75 in Warren County.

        At 7:19 p.m., the Ohio State Highway Patrol got a call that the truck was on its side on the ramp, a dispatcher at the patrol's Lebanon post said. The ramp reopened about 11 p.m.

        The truck driver, whose name was not available, was treated at a hospital and released, the dispatcher said.

Robber of pizzeria in Reading is sought
        READING — Police are searching for an armed man who robbed LaRosa's Pizzeria, 410 W. Benson St., Tuesday afternoon.

        The robbery occurred at 4:30 p.m. The man brandished a revolver, took cash and fled, police said.

        The robber was described as a white man, 25 years old, 5-foot-9 to 5-foot-10, medium build, wearing a dark hat, dark checkered coat and jeans.

Lawyer: Juror didn't understand process
        COLUMBUS — A juror's confusion over a judge's instructions resulted in a death sentence for a leader of the 1993 Lucasville prison riot, his lawyer told the Ohio Supreme Court on Tuesday.

        Jurors considering a sentence for Jason Robb should have been told that failing to reach a unanimous decision on a death sentence would have automatically resulted in a life prison sentence, Mr. Robb's attorney told the court.
