Appeals court upholds conviction of video clerk

        HAMILTON — The 12th District Court of Appeals upheld on Monday the conviction last year of a Millville adult video store clerk on a misdemeanor charge of selling sexually explicit material to an underage person.

        A Butler County Common Pleas jury convicted Billie J. Doan, a clerk for a VIP Video store, of disseminating material harmful to a juvenile, but acquitted her of the more serious felony charge of disseminating obscene material to a juvenile.

        Ms. Doan had sold adult videos to a 17-year-old boy who had been sent into the store by the Butler County Sheriff's Department with the permission of his parents.

        Ms. Doan received a six-month suspended sentence and a $1,000 fine and was ordered to perform 120 hours of community service.

        The appeals court rejected Ms. Doan's argument that she was entrapped. The case was prosecuted by Assistant Prosecutor Dan Gattermeyer.

        Prosecutor John Holcomb said the ruling underscores the point that those who sell adult material in Butler County risk serious consequences.
