Judge urges deal in methadone fight
City wants to prohibit clinic

COVINGTON U.S. District Judge William O. Bertelsman could decide within a month whether this city can prohibit a methadone clinic from operating within city limits.
A trial to decide the 2-year-old federal court battle involving the City of Covington and the MX Group Inc. of Pittsburgh is set for Jan. 18-19.
There will be no jury, leaving Judge Bertelsman to make the final decision.
Methadone, a synthetic narcotic, can help heroin addicts kick their habits.
At a brief Thursday hearing, he urged the two sides to settle.
Get it resolved or I'll resolve it, he told attorneys.
The lawsuit filed by MX Group claims Covington violated the Americans with Disabilities Act because there's no zone in Covington permitting a clinic serving residents dis-
abled by their drug addictions.
City attorneys have said MX Group's case was weakened this summer, when a U.S. Supreme Court ruling denied ADA protection to people with easily correctable conditions.
The city's attempts to provide a zoning change so that a methadone clinic could open in Pioneer Industrial Park are on hold until the court case is resolved.
