State AG confirms inquiry
Ludlow fire department gaming checked
By Cindy Schroeder
The Cincinnati Enquirer
The Kentucky attorney general's office confirmed Monday that it is coordinating an investigation into the Ludlow Volunteer Fire Department's charitable gaming practices.
Witnesses who appeared before a Kenton County grand jury last year had said they were questioned about the fire department's charitable bingo.
But the state didn't confirm its involvement in the investigation until issuing an attorney general's decision on another matter.
Spokesman Corey Bellamy confirmed the attorney general's involvement in the investigation Monday, after it was mentioned in an open-records decision the Enquirer obtained Monday.
In her April 6 decision, Assistant Attorney General Amye L. Bensenhaver chastised the fire department for failing to promptly hand over 1997-98 financial records to Ludlow resident Christine Anderson.
Counsel for the fire department blamed the delayed response on several factors, including Ludlow's financial crisis and the state's ongoing investigation into the fire department's finances.
Lawyer Steve Martin told the attorney general's office that the city refused to turn over records of its payments to the fire department to supplement fire department records.
He also argued that because of the state's investigation of the fire department, most of the records sought by Ms. Anderson were in the possession of Tim Feldhaus, who's serving as independent counsel to the fire department.
Mr. Martin said Monday that the fire department hopes to compile the requested documents as soon as possible, but added that they're scattered all over the planet.
Ms. Bensenhaver said the fire department's argument that its own financial records through 1998 were in the possession of its independent counsel, Mr. Feldhaus, are unpersuasive.
