Auditor waives right to jury for trial


Harassment case scheduled to be heard in June

        UNION TOWNSHIP — The telephone harassment trial involving Butler County Auditor Kay Rogers will begin June 22 in Butler County Area III Court.

        Ms. Rogers, accused by her ex-husband, Gary Rogers, of repeatedly calling him after he asked her to stop, decided Tuesday to waive a jury trial and be tried by a judge.

        “Kay feels there's been too much time and expense — both her own and the public's — expended on this case,” said her attorney, David Davidson.

        Visiting Judge Larry Moore will hear the case. Steve Tolbert has been appointed special prosecutor. The trial date was set during a conference Tuesday afternoon involving Judge Moore, Mr. Tolbert, Mr. Davidson and Ms. Rogers.

        A telephone complaint filed by Mr. Rogers led to the April 18 arrest of his ex-wife.

        Judge Moore also will decide another case involving Ms. Rogers' sister, Denise Schipper, in Area III Court.

        Ms. Schipper, 40, of Union Township, was charged with domestic violence after allegedly slapping Ms. Rogers in the face April 30.

        At the request of Ms. Rog ers, Magistrate Dwight Packard recommended Monday that the charge be dropped. He said he thought it was an isolated incident that could best be handled within the family.

        Judge Moore will rule on the magistrate's recommendation.

        A pretrial hearing is scheduled May 23. Special prosecutor Pam Sears is handling this case.
