DNA leads to suspect in rape from 1993

Man's already in prison

By Michael D. Clark
The Cincinnati Enquirer

HAMILTON — A convicted murderer already behind bars has been indicted in a 1993 rape and attempted murder case. A DNA match has linked him to an attack on a local woman.

Dustin Hendrix was convicted earlier this year for murdering Patricia Ann Barrett, 27, in August 1999 and dumping her body in a farm shed outside Oxford.

In March he began serving a 16-years-to-life sentence. But a Butler County grand jury this week indicted the jailed killer after prosecutors obtained a court-ordered blood sample from Mr. Hendrix as part of their investigation into the 1993 attack.

Butler County Prosecutor Dan Gattermeyer said that during his office's review of Mr. Hendrix's record, staffers discovered that a “rape kit” containing bodily fluids obtained in the 1993 rape investigation was still avail able.

“We got a search warrant and got his blood so we could do a DNA match,” said Mr. Gattermeyer. “We don't often come across good evidence in cases seven years old.”

Mr. Hendrix, who is imprisoned at the Lebanon Correctional Institution, is accused of raping and attempting to kill the 39-year-old woman, a former Hamilton resident. Prosecutors declined to discuss details of the case.

Mr. Hendrix, 30, of Hamilton, was convicted Feb. 10 of murder, felonious assault, abduction and gross abuse of a corpse. The body of Ms. Barrett was discovered in Oxford Township.

Witnesses said Ms. Barrett met Mr. Hendrix at a Hamilton bar Aug. 12, 1999 and he went to a party with her and her friends. Prosecutors said Mr. Hendrix strangled Ms. Barrett in his car in Hamilton after she refused to have sex with him.
