Kidnap suspect in court
Victim was found dead in New Jersey

BURLINGTON Gregory J. Marcinski, accused of capital kidnapping in the disappearance of a Florida businessman whose body was later found in New Jersey, made a brief appearance Tuesday in Boone Circuit Court while his attorneys filed motions.
Mr. Marcinski, 23, of Brick, N.J., chatted with attorneys Tim Schneider and David Fessler in Judge Jay Bamberger's court. Mr. Marcinski later was returned to the Boone County jail.
He is scheduled to return to court Oct. 24 for a pre-trial hearing, at which time the judge will rule on the attorneys' motions.
Authorities charge that Mr. Marcinski kidnapped Paul Jeffrey Gale of Naples, Fla., on April 17 from a Florence motel. Mr. Gale, a 28-year-old computer consultant and native of Great Britain who was in Northern Kentucky on business, had been dating Mr. Marcinski's ex-girlfriend.
Police say Mr. Marcinski impersonated an FBI agent at the Florence Holiday Inn to find Mr. Gale. They say he awakened Mr. Gale, handcuffed and frisked him, and drove off.
Mr. Marcinski was arrested April 20 and extradited to Kentucky. Mr. Gale's burned body was found in a shallow grave about 2 miles from Mr. Marcinski's New Jersey home on April 27.
Under Kentucky law, kidnapping can be a capital offense if the victim is not released alive. Possible penalties are death, life without parole, no parole for at least 25 years, and a prison term of at least 20 years.
