Firm's former VP may be part of scheme


Conspiracy suspected at Ohio landfill to gain favors from regulators

        COLUMBUS — A former vice president of the V Group of Cleveland might have been involved in a conspiracy at an eastern Ohio landfill to win favors from environmental regulators, a federal prosecutor said.

        The V Group is a design and construction-management company owned by Paul Voinovich, brother of U.S. Sen. George Voinovich.

        Assistant U.S. Attorney Kathleen Brinkman said Thursday during a phone conference with U.S. District Judge Edmund A. Sargus Jr. that Clark Miller is the unnamed conspirator referred to as a “subconsultant” in several federal indictments stemming from an investigation of alleged corruption in eastern Ohio.

        The V Group repeatedly has denied that any executives of the company were involved in wrongdoing. A telephone message seeking company comment Friday was left for spokeswoman Heidi Armstrong.

        Mr. Miller could not be reached. No phone listing for him could be found.

        Judge Sargus held the conference call to discuss amendments to a juror questionnaire for the Nov. 8 trial of Robert S. Vukelic, owner of the Pine Hollow landfill near Steubenville. Mr. Vukelic, accused of paying $169,750 in kickbacks over 2 1/2 years to obtain dumping permits for the landfill, has pleaded not guilty to charges in a 37-count indictment.

        Five other men — Pasquale J. DeLuca, his son Ronald, Vincent R. Zumpano, M. Anthony Fabiano and Richard Canestraro — have pleaded guilty to corruption-related charges.

        Ms. Brinkman identified Mr. Miller as the unnamed conspirator as she, Judge Sargus and Mr. Vukelic's attorneys — David Jividen and Peter Olivito — discussed a questionnaire to be mailed to 200 prospective jurors.

        The first question lists people involved in the case and asks whether the prospective jurors know any of them.

        According to court records, Ms. Brinkman told Judge Sargus: “I would request that you add Clark Miller to the first question because he is the subconsultant who was part of the contract in which Mr. Vukelic, the DeLucas, Mr. Zumpano and Mr. Canestraro entered into. It's like the guts of this case.”

        Mr. Vukelic's attorneys didn't object to Mr. Miller's name being added to the list.
