Woman convicted in mother's death
Jury recommends year for woman, 70
The Associated Press
EDDYVILLE, Ky. A 70-year-old woman was convicted of reckless homicide Thursday for the death of her 97-year-old mother.
A Lyon County jury recommended for Mary Calvert a one-year prison sentence, the shortest possible term. Ms. Calvert could have received up to 10 years if she had been convicted of second-degree manslaughter.
Beatrice Gray, who lived alone, was taken by ambulance to Caldwell County Hospital on Jan. 18 after a home health nurse noticed Ms. Gray's large, deep bedsores and called her supervisor.
Ms. Gray died nine days later. Ms. Calvert was indicted May 15.
This was a difficult case for the prosecution as well as the defense, said Commonwealth Attorney G.L. Ovey. There are basically no winners, but I believe that justice was done.
Ms. Calvert, who has served no time in jail since her arrest, will remain free until her sentencing Jan. 4. Circuit Judge Bill Cunningham will decide whether Ms. Calvert should serve jail time or be placed on probation.
Mr. Ovey said he will not recommend probation.
I feel like given the nature and the circumstances of the offense, notwithstanding her age, that I would not be fulfilling my responsibility as commonwealth attorney in recommending probation, he said.
