Biological parents appeal to Ky. Supreme Court

        FRANKFORT — The biological parents of 3-year-old Justin Moore asked the Kentucky Supreme Court this week to overturn a lower court ruling that granted custody to an Ohio couple wanting to adopt him.

        The biological parents, Regina Moore and Jerry Dorning of Florence, said they were not fully aware of the legal consequences when they signed consent forms giving Justin up for adoption. They previously had allowed Richard and Cheryl Asente of Girard, Ohio, to adopt Justin's older brother, Joey, then asked if they also wanted Justin.

        “It is of the utmost importance that this court provide guidance to birth parents, prospective parents and the attorneys who represent them as to what constitutes voluntary and informed consent,” the couple said in court documents.

        But the Asentes believe the issue of consent already has been resolved.

        “The Court of Appeals has already answered that question, and we stand with the majority opinion of the Court of Appeals,” said Mitchell Charney, the Asentes' attorney.

        It could be several weeks before the Supreme Court decides whether it will hear the case.

        The Kentucky Court of Appeals ruled that Ms. Moore and Mr. Dorning had read and understood the consent forms.
