LEBANON A Tennessee man has been indicted by a Warren County grand jury on felony charges, accused of posing as a police officer and pulling over a young woman in an attempt at sex last month in Springboro.
Mark Mixner, 37, of Knoxville was indicted on charges of kidnapping, impersonating a peace officer and possession of criminal tools. The indictments were filed Monday, Warren County Prosecutor Tim Oliver said.
That's consistent with what he was charged with, said Dennis Lieberman, Mr. Mixner's lawyer. We anticipated that he would be indicted on these charges. He will answer them.
Mr. Lieberman would not comment further on the case. Mr. Mixner remains free on bond.
Mr. Mixner, a business owner and father of two daughters, is accused of using flashing red and blue lights to pull over the 19-
year-old woman Dec. 7 on Ohio 741 just after she had left Bojangle's nightclub in West Carrollton.
In a preliminary hearing last month, the woman said a man, later identified as Mr. Mixner, walked up to her vehicle and asked her if she had been drinking. She denied being intoxicated, and he told her to pull off the main road onto Pennyroyal Road, she testified.
He then ordered her into his unmarked Chevrolet Blazer and identified himself as a West Carrollton police officer working with Springboro police to find drunken drivers. The woman said Mr. Mixner asked her to perform oral sex and other sexual favors. She declined, and he let her leave after she began crying.
Springboro police said three sets of flashing lights, a ski mask, a black, brown and red wig attached to a baseball cap, and three pairs of eyeglasses were found in the Blazer when Mr. Mixner was arrested a short time later in Bojangle's parking lot.
Springboro Detective Tim Parker said the incident is particu larly troubling to law enforcement officials.
It's something the public needs to be aware of, Detective Parker said. They think they are doing the right thing when actually they are becoming a victim. If an officer in a uniform or plainclothes ever makes inappropriate requests or demands, call 911.
Other indictments filed by the grand jury include:
Deanna Lee Williams was charged with misuse of credit cards and receiving stolen property, both felonies. Ms. Williams of Middletown allegedly used a customer's credit card after it was left at the business where she worked, Mr. Oliver said.
James G. Reising of Springboro is charged with possession of cocaine, a felony.
Adam Spatz of Monroe is charged with aggravated vehicular homicide, a felony, in connection with the death of Clinton Barnett of Franklin in a December car crash in Deerfield Township.
