Court rejects appeal in baby killer's case
The Associated Press
CINCINNATI A man sentenced to 20 years to life in prison for killing a 15-month-old girl will not get a new trial.
The 6th U.S. Circuit Court of Appeals on Friday rejected the appeal of James Doan, who was convicted of murder and child endangerment in the September 1993 death of his girlfriend's daughter.
Prosecutors had played taped confessions for the jury in which Mr. Doan admitted shaking and striking Star Hollingsworth and burning her face with hot water because she had been crying. The girl's mother was at work when Mr. Doan, who was baby-sitting, beat and killed the child, prosecutors said.
A lawyer for Mr. Doan argued he should be retried because a juror had conducted an experiment at her home during the trial to decide whether Mr. Doan was telling the truth, and had told other jurors of the result.
The prosecution presented adequate, independent evidence to support the conviction by undercutting several of Mr. Doans' explanations of how the child was injured, the court concluded.
