Woman guilty in crash -- again
By Earnest Winston
The Cincinnati Enquirer
MASON A West Chester Township woman whose vehicular homicide conviction was reversed by a state appeals court last year was again found guilty by a Mason Municipal Court jury Friday.
Janet L. Kortum faces up to six months in jail, a $1,000 fine and suspension of her driver's license for the first-degree misdemeanor.
Judge Steve Batsche will sentence Mrs. Kortum on April 3. Until then, she remains free.
I hope the matter ends at this point, Mason Prosecutor Robert Peeler said. Part of the healing process for everyone involved, I believe, begins at the conclusion of this case.
Bobby Marshall's motorcycle struck Mrs. Kortum's van Aug. 5, 1999, at the intersection of Mason-Montgomery Road and Irwin Simpson Road. The 49-year-old Mason man, who was not wearing a helmet, died from severe head injuries. He was traveling at 48 mph; the speed limit was 55.
In October, the Ohio 12th District Court of Appeals ruled that Judge Batsche should have granted Mrs. Kortum's request for a mistrial when it was discovered that the speed limit at the scene of the crash was erroneously reported on a state trooper's crash report.
Neither Mrs. Kortum nor her lawyer, Martin Pinales, could be reached for comment Friday.
