Porn arrest may be Ky.'s biggest


Lexington man accused of distributing children's images

        LEXINGTON, Ky. — Prosecutors are calling the weekend arrest of a Lexington man on child pornography charges one of the largest ever in Fayette County, and perhaps in Kentucky.

        Though only 23 computer photographs of minor girls were cited in court documents outlining charges against Timothy Wayne Kellogg, the actual number of images is much larger, County Attorney Margaret Kannensohn said on Saturday.

        Mr. Kellogg, 41, was arrested at his home on Friday night and charged with distributing matter portraying a sexual performance by a minor and promoting a sexual performance by a minor.

        “This may be one of the largest-scale investigations the county and state has ever seen,” Ms. Kannensohn said.

        Mr. Kellogg's attorney, Marcel Bush Radomile, said Saturday that a controversial book of photographs by a nationally known photographer is at the heart of the charges against her client.

        “At this point, he must be considered innocent,” Mr. Radomile said.

        “I hope the public won't condemn him until all the evidence is out.”

        Court documents allege that in May 2000, Mr. Kellogg “prepared, printed, and procured pictures showing explicit sexual performances by and on a minor girl that appears to be less than 16 years of age.”

        According to court documents, Mr. Kellogg already faces other sex-related charges in Fayette Circuit Court, including first-degree sexual abuse, first-degree sodomy, possession of matter portraying a sexual performance by a minor, and possession of a handgun by a felon.

        Those charges were brought in May 2000, and Mr. Radomile said the latest charges against Mr. Kellogg resulted from the 2000 case.

        The images at issue in the latest charges were allegedly stored in the hard drive of a computer that authorities say Mr. Kellogg owned, Mr. Radomile said.

        Some or all of the depictions were photographs by artist Sally Mann, whose large black and white prints often have been regarded as controversial, and have evoked praise as well as condemnation whenever they are exhibited, Mr. Radomile said.

        Mr. Kellogg was in the Fayette County Detention Center on Saturday on a $50,000 cash bond.
