Livingston says he was only trying to get OK for protest

Closing arguments will be held today in the trial of former WDBZ-AM (1230) radio talk show host Nate Livingston. He is charged with four misdemeanors for interrupting Oktoberfest opening ceremonies last September.

On Thursday, Mayor Charlie Luken testified that when Mr. Livingston, 31, walked onstage at Fountain Square and refused to leave, the mayor was forced to stop his speech.
Mr. Livingston testified in his own defense Thursday, saying he went on stage because police refused his request to contact a Cincinnati police captain for permission to protest. He said he thought the mayor would honor his request.
Mr. Livingston and others were on Fountain Square protesting the closure of several downtown restaurants during the 2000 Coors Light Festival when police told him he couldn't use a megaphone he carried.
Mr. Livingston said he wanted an understanding of why he was prohibited from using the bullhorn and asked officers to contact District 1 commander Capt. Vince Demasi.
