Change of venue denied in DiGiuro case

LEXINGTON Attorneys for the man accused of killing former Kentucky football player Trent DiGiuro were denied a request to move the trial by a Fayette Circuit judge Friday.
Shane Ragland's attorneys argued their client would not receive a fair trial in Lexington because of intense media coverage. The trial is to begin Aug. 6.
Fayette Circuit Judge Thomas Clark denied the request, but Assistant Commonwealth Attorney Mike Malone said the venue issue could be revisited if prosecutors and defense attorneys struggle with jury selection.
Mr. DiGiuro was killed by a sniper as he sat on his front porch during a party July 17, 1994. No arrests were made until July 2000, after Mr. Ragland's ex-girlfriend told police he admitted to her he killed Mr. DiGiuro.
Mr. Ragland, 27, is charged with murder. He is free on $1 million bond.
Mr. Ragland's defense team also filed a motion Friday to suppress evidence they claim was gathered under false pretenses.
Attorney Bill Johnson said authorities used accusations that Mr. Ragland was growing and selling marijuana to obtain search warrants of homes owned by Mr. Ragland's parents. Mr. Johnson argued authorities weren't looking for drug evidence at all, but were using the warrants to search for evidence in the killing.
A hearing on the motion to suppress is scheduled for July 11.
