Ballot suit thrown out

HAMILTON The Butler County Board of Elections threw out a citizen's protest to keep Fairfield mayoral candidate Erick Cook and council candidates Mark Scharringhausen and Robert Wolpert off the Nov. 6 ballot.
Mr. Cook and Mr. Scharringhausen are council members and Mr. Wolpert is mayor.
Joseph Buchheit, of Fairfield, had filed a complaint arguing that the three should not be allowed to seek election because the city charter requires employees to resign before running for office.
He argued that the three are city employees because they are each paid $6,500 a year as members of council.
But after consulting with Fairfield Law Director John Clemmons, the board ruled there is a distinction between a city employee and an elected official.
