Harmony Community School loses occupancy bid

Harmony Community School was denied a temporary certificate of occupancy Monday for its Price Hill building by Cincinnati's board of zoning appeals.
The school's attorney said Harmony will appeal.
Monday's vote reversed a September ruling by Cincinnati's director of buildings and inspections that granted the temporary occupancy.
I think the board reached the correct decision, said Matt Fellerhoff, attorney for Harlan Graphic Arts Services Inc. Harlan is adjacent to Harmony in an industrial park.
Harlan had appealed the original ruling, saying the school was not incidental to a church as required in a manufacturing zone. Cincinnati's zoning code says churches, Sunday schools and places of worship are permitted in areas zoned for manufacturing use.
The 500-student middle/high school rents out part of the facility to Harmony science teacher the Rev. Steven Wheeler, who said he conducts services there on Sundays for about a half-dozen people.
We weren't surprised by the ruling, said Harmony attorney Phyllis Brown. Obviously it will be appealed. We are confident Harmony School will remain at 2090 Radcliff Drive.
Harmony will file the appeal with Hamilton County Common Pleas Court. We believe the judge will let the students stay (at the school) during the course of the appeal, Ms. Brown said.
The school relocated to the former Slush Puppie Corp. building in September, after vacating its building in a Bond Hill shopping center.
