Drees sues city over permits' cost

LEBANON Northern Kentucky's largest homebuilder is suing the city of Mason, saying the developer was overcharged more than $360,000 for three permits.
Drees Co. said it was overcharged when it paid Mason about $1.6 millionfor the permits to tap water and sewer services for the Twin Fountains, a multifamily development, according to a lawsuit filed Dec. 12 in Warren County Common Pleas Court. Drees applied for the three permits between December 1998 and June 2000.
According to the lawsuit, Subsequent to paying the fees assessed by the city for all three permits, Drees, after further review of the ordinances and revised ordinances, became aware of overcharges by the city for the permits and corresponding overpayments.
Despite repeated requests, Mason has refused to refund the amount it overcharged the Fort Mitchell-based developer for the permits, according to the suit. Drees is seeking the amount overcharged on one count each of breach of contract and payment by mistake.
Mason Law Director Ken Schneider said the city has not received a copy of the lawsuit.
I am aware that the Drees Company intend to make a claim, and our initial review of the records indicates that the city also has a claim against the Drees Company, Mr. Schneider said.
