Livingston allowed to pursue lawsuit

Former radio talk-show host Nate Livingston won a mini-battle Wednesday in his war to get his job back at WDBZ-AM (1230).

Hamilton County Common Pleas Judge Thomas Crush denied a request by Blue Chip Broadcasting, which owns WDBZ, to dismiss Mr. Livingston's lawsuit against the company.
The lawsuit charges the company with violating the Whistleblower Protection Act, breach of contract, wrongful termination, unauthorized release of personnel information and defamation of character.
He has asked for $4 million in damages and his job back.
Mr. Livingston was fired in June a few days after he said he wrote a memo to L. Ross Love, Blue Chip Broadcasting CEO and president, threatening to publicize an alleged deal the station had made not to criticize Cincinnati Mayor Charlie Luken after the April riots.
When Mr. Luken subsequently appointed Mr. Love to hiscommission to help the city deal with the aftermath of the riots, it amounted to a bribe, Mr. Livingston claimed.
Station officials have denied the allegation and argued that Mr. Livingston was technically not an employee; rather he was under contract only as a talk-show host.
The judge also denied a request by Mr. Livingston to have his job reinstated immediately.
The case will return to court in June.
