N. Fairmount man's suit claims two officers kidnapped him, dumped him in city park

A North Fairmount man claimed in a federal lawsuit Tuesday that two Cincinnati police officers kidnapped him, drove him to a park and sprayed chemical irritant in his face.
Courtney Evans, 22, said the incident occurred April 13 after police handcuffed him in the front yard of a South Cumminsville house and ordered him into their police cruiser.
Mr. Evans said the officers sprayed him with irritant and left him in Mount Airy Forest at 2:30 a.m.
Police have been investigating the complaint for more than a month. The two accused officers, Michael Mercer and Robert Litman, remain on desk duty pending the outcome of the investigation.
Attorneys for the city could not be reached for comment Tuesday.
Mr. Evans' lawsuit, filed in U.S. District Court, claims the officers violated his civil rights.
You have a majority of cops out there doing a good job, said Mr. Evans' attorney, Kenneth Lawson. Those that aren't have to be held accountable.
According to the lawsuit, Mr. Evans was waiting for a ride outside the South Cumminsville home when the officers grabbed him.
He claims the officers took his cell phone and tossed it in a mailbox so he could not call for help. Another officer, on patrol in the park, found Mr. Evans and took him to a police station so he could file a complaint.
