LG&E faces charges in deaths


Commission orders officials to appear

        LOUISVILLE — Louisville Gas & Electric officials have been ordered to appear before the Public Service Commission regarding possible violations in the events that led to the deaths of two men.

        LG&E is reviewing the order.

        In early February, Jose Chavez and Joshua Nottingham of Louisville were killed and Joshua Clayton and Brent Levy, also of Louisville, were injured when they tried to move a downed power line blocking their all-terrain vehicles.

        Mr. Chavez and Mr. Nottingham were electrocuted in the accident, which occurred in a wooded area in southwestern Jefferson County. Mr. Clayton and Mr. Levy burned their hands while using a stick to try to move the line away from Mr. Chavez and Mr. Nottingham.

        The commission is charging LG&E with the following violations: failure to promptly repair, disconnect or isolate a power line with a recorded defect; failure to maintain a temporarily out-of-service power line in a safe condition; and failure to have a designated person in charge of the safe operation of the repair of the line.

        LG&E could be fined up to $2,500 for each violation. The hearing is set for July 23.

        David Freibert, LG&E spokesman, said the company has received the order and is reviewing it.

        “We have aggressively participated with the Public Service Commission in the investigation and will actively participate in the filing of information and in the public hearing,” Mr. Freibert said.

        The victims' families could not be reached for comment.

        In the accident, one part of the 7,200-volt line had been burned to the ground and the other had a blown fuse after being struck by falling trees in an early morning storm the previous day. LG&E had sent a worker to re-fuse one part of the line, but he did not repair or remove the portion that burned to the ground. According to details of the PSC's order, the LG&E worker was not aware that part of the power line had fallen to the ground.
