Funds OK'd for lawyer in suit defense

FRANKFORT - A panel of state lawmakers Monday allowed funding for the Council on Postsecondary Education's legal defense in a lawsuit brought against them by the chairman of Eastern Kentucky University's governing board.
The General Assembly's Government Contract Review Committee allowed a contract between the council and its attorney, Mark Guilfoyle, of Northern Kentucky. Guilfoyle would be paid $125 an hour, up to $9,000 for his work defending the lawsuit brought by Fred Rice against the council.
Rice is suing the council over a law the General Assembly passed this year requiring the council to fire Rice because he moved to the Virgin Islands. He has obtained a court order to at least temporarily block his removal.
Gov. Paul Patton had vetoed a different House bill that would have ousted any regional university regent living outside the 50 states or District of Columbia.
