A Springfield Township man is accused of ordering two friends to kill his girlfriend's former boyfriend after seeing them together.
But when Kevin Harley gave the nod to kill March 22, prosecutors say, he pointed to the wrong man.
His friends, who have not been arrested, fatally shot James Turner as he walked on Birch Ridge Drive, prosecutors said.
Turner, 32, of Seven Hills, didn't know the suspects.
A Hamilton County grand jury indicted Kevin Harley, 18, Monday on charges of murder, complicity and illegally having a weapon.
Harley and the person he allegedly wanted to kill had problems in the past. Harley once chased him through Seven Hills Shopping Center with a TEC-9 handgun, but his intended victim escaped, according to prosecutors.
Then, on March 22, when Harley thought he saw him on Birch Ridge Drive, he called his friends. They drove by and Harley nodded, prompting his friends to turn around, get out of the car and shoot Turner to death, prosecutors said.
Harley was arrested May 14 and is being held in the Hamilton County Jail on $500,000 bond.
In 2000, when Harley was in eighth grade, he was arrested for firing a .380-caliber semiautomatic handgun into the ceiling of his math classroom at Mount Healthy North Middle School. Students were evacuated while a Springfield Township police officer talked to Harley until he put the gun on a desk and surrendered.
