FRANKFORT - The Kentucky Court of Appeals on Friday said the state consumer protection act has a firm two-year time limit for making an allegation of deception.
It rejected a notion that the statute of limitations should commence from the date a deceptive act is discovered.
The appeal was by Linda Cook, who sued State Farm Insurance in Boone County Circuit Court over allegedly deficient repairs to her car from an accident in 1996. She said problems with the car were not documented until 1998.
The appeals court agreed with Cook that the consumer-protection law is to be construed to afford broad protection. But it said the law "is also specific as to when the action must be brought."
However, the court reinstated a part of Cook's lawsuit alleging unfair trade practices and breach of contract.
Those claims were made under different statutes.
Boone officer finishes FBI academy program
BURLINGTON - Lt. Col. Robert Reuthe of the Boone County Sheriff's Department was among 252 law enforcement officers who graduated from the FBI National Academy Program at Quantico, Va.
The academy offers 10 weeks of advance investigative, management and fitness training for selected officers having proven records as professionals within their agencies.
On average, these officers have 19 years of law enforcement experience and usually return to their agencies to serve in executive-level positions.
