FRANKFORT - A judge has ordered the state to turn over documents explaining how it executes inmates to attorneys for a man facing lethal injection for a 1990 murder.
Thomas Clyde Bowling faces execution for killing the owners of a dry-cleaning business in Lexington.
Attorneys for Bowling are trying to block his execution by challenging the state's procedure involving lethal injection in a lawsuit.
In a Wednesday ruling, Judge Roger Crittenden gave the state seven days to turn over its protocol for administering lethal injections, but he agreed to have the document sealed.
The U.S. Supreme Court has declined to hear Bowling's appeal, and the Kentucky Attorney General has asked Gov. Ernie Fletcher to set an execution date. Fletcher is still reviewing the request.
Bowling, 51, was sentenced in January 1991 to die for killing Eddie and Tina Earley, owners of the Earley Bird Cleaners, who were shot in their car outside their shop. Their 2-year-old son, Christopher, was also shot in the assault, but he survived.
